Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of the OsmFX Mods webstore (“Webstore”) operated by us (“OsmFX Mods”, “we”, “us”, “our”). Together with our Refund Policy, they form the agreement between you and us in respect of your purchase of FiveM scripts and other digital products (“Products”) from the Webstore (“Contract”).

Please read these Terms carefully before placing an order. By placing an order, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not place an order.

We may update these Terms from time to time. The version in force at the time of your order will apply. We recommend that you save or print a copy for your records. These Terms are provided in the English language only.

2. About OsmFX Mods

OsmFX Mods is a webstore selling digital FiveM scripts and related content for use on game servers. We develop and/or license the Products offered on the Webstore and sell them to you as the merchant. When you buy a Product, you enter into a contract with us; no separate contract is formed between you and any third-party platform (such as FiveM, Tebex, or game server software providers) in respect of the sale itself.

For support, refund requests, or any questions about your order or these Terms, contact us via our Discord server. We will respond as reasonably possible. For refund requests, please also refer to our Refund Policy.

4. Products and license

All Products sold on the Webstore are digital (e.g. FiveM scripts, resource packs). We grant you a limited, non-exclusive, non-transferable license to use the Product for your own personal or server use, in accordance with any documentation or usage terms we provide. Products are licensed, not sold; you do not acquire ownership of the software or its source code unless we expressly agree otherwise in writing.

You may not redistribute, resell, sublicense, share, or otherwise make the Product available to third parties (except as necessary to run it on a server you control, where the license permits). You may not reverse engineer, decompile, or attempt to extract source code from our Products except where expressly permitted by applicable law. Any use beyond the license granted here is a breach of these Terms.

In these Terms we may use words such as “sell”, “purchase”, or “buy” for readability; they refer to this limited license unless the context requires otherwise.

5. Order process and payment

Orders are placed through our Webstore and may be processed via our chosen payment and checkout provider (including Tebex). You must provide accurate payment and account information. By completing checkout, you represent that you are authorised to use the chosen payment method and that you agree to these Terms and our Refund Policy.

Prices are as shown on the Webstore at the time you submit your order. We may change prices at any time; changes do not affect orders we have already accepted. Any applicable taxes or fees (e.g. VAT) will be shown or communicated during checkout where required by law.

We may refuse or cancel an order (e.g. for suspected fraud, abuse, or violation of these Terms) at our discretion. If we cancel after payment, we will refund you in accordance with our Refund Policy.

6. Delivery and access

Delivery of digital Products is typically by download link, key, or access instructions sent to you (e.g. by email or via the checkout platform) after payment is confirmed. You are responsible for keeping any access credentials secure. We do not guarantee uninterrupted or error-free access to delivery systems or to the Webstore. If you do not receive access after a successful payment, contact us via Discord with your order details and we will work to resolve the issue.

7. Refunds

Our refund policy is set out in our Refund Policy. In summary: once a Product is purchased, it is non-refundable unless a qualifying script issue is identified and not resolved in due time, as described in that policy. By placing an order, you acknowledge that you have read and accept our Refund Policy. We do not give refunds for change of mind, server bans, or inability to use a Product due to your own setup or third-party services.

8. Support and problems with Products

We will make reasonable efforts to help you with technical issues related to our Products (e.g. installation, configuration). Contact us via Discord with your order details and a clear description of the problem. If the issue is caused by your environment (e.g. other scripts, server configuration) or by third-party services (e.g. game servers, frameworks), we may direct you to relevant resources but are not obliged to fix those third-party issues. Resolution of qualifying issues is subject to our Refund Policy where a refund is requested.

9. Intellectual property

All rights in the Webstore (design, text, branding, layout) and in our Products (code, assets, documentation) remain our property or our licensors'. You receive only the limited license described in section 4. You may not copy, scrape, or use our Webstore or Products for any purpose other than your licensed use. Trademarks and names (including “OsmFX Mods”, “OsmFX”) are our property; do not use them without our prior written permission.

10. Use of the Webstore

You may use the Webstore only for lawful, personal (or business) purchasing of our Products. You must not use it to: (a) violate any law or third-party rights; (b) distribute malware, abuse, or attempt to gain unauthorised access to our or others' systems; (c) scrape, spider, or automate access in a way that burdens or disrupts the Webstore; (d) resell or redistribute our Products in breach of section 4.

We may suspend or terminate your access to the Webstore or your license to use a Product if we reasonably believe you have breached these Terms.

11. Age restriction

You must be at least 16 years old to purchase Products from the Webstore. By placing an order, you confirm that you meet this requirement. If we discover that a purchaser is under 16, we may cancel the order and refund in accordance with our Refund Policy where applicable.

12. Disclaimers

The Webstore and Products are provided “as is”. We do not guarantee that the Webstore or any Product will be uninterrupted, error-free, or free of harmful components. We do not guarantee compatibility with every server setup, framework version, or third-party software.

Our Products are digital items for use in game/server environments. They have no cash value and cannot be exchanged for real-world currency. Use of our Products on any server or platform is at your own risk; we are not responsible for bans, server issues, or losses arising from your or a server owner's use of our Products.

13. Limitation of liability

To the fullest extent permitted by law: (a) we are only liable for loss or damage that is a foreseeable result of our breach of these Terms or our negligence, and (b) we are not liable for indirect, consequential, special, punitive, or exemplary damages, or for loss of profits, goodwill, data, or business opportunity.

Our total liability to you in respect of any order or Product shall not exceed the amount you paid us for that order. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

If you are a consumer, your statutory rights (e.g. in relation to faulty goods or misdescription) are not affected by these limitations, except where the law allows.

14. Right of withdrawal (EU customers)

If you are a consumer in the European Union, you may have a right of withdrawal. For digital content, this right often ends when you have agreed to begin download or access and have started downloading or accessing the content. By completing checkout and receiving access, you may have consented to the start of performance and acknowledged that your right of withdrawal may end at that point.

Where the right of withdrawal still applies, you may inform us in writing (e.g. via Discord or email) of your decision to withdraw. We will reimburse you without undue delay and in any event within 14 days of being informed, using the same payment method. This section does not replace our Refund Policy; it describes a separate legal right that may apply in the EU.

15. Third-party services

The Webstore may link to or use third-party services (e.g. payment processors, checkout platforms such as Tebex, Discord). Your use of those services is subject to their own terms and policies. We are not responsible for their availability, content, or actions. Any charges or obligations you incur with third parties are your responsibility.

16. General

Entire agreement: These Terms and our Refund Policy constitute the entire agreement between you and us regarding the Webstore and Products, and supersede any prior discussions or agreements.

Changes: We may change these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Continued use of the Webstore or Products after changes constitutes acceptance of the updated Terms. For existing orders, the Terms in force at the time of the order apply unless we are required by law to apply different terms.

Severability: If any part of these Terms is held invalid or unenforceable, the remaining parts remain in effect.

No waiver: Our failure to enforce any right under these Terms does not waive that right. Any waiver must be in writing.

Governing law and jurisdiction: These Terms are governed by the laws of England and Wales. Disputes shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are resident in Scotland or Northern Ireland, you may also bring proceedings in your country of residence. Nothing in these Terms affects your rights as a consumer under the mandatory laws of your country of residence.
